Southampton Village resident takes ARB to court

I think you tend to leave out two important facts about my "war":
(1) I am a land-use litigator; and
(2) the key issue is not the size of the houses, but the fact that the ZBA and
ARB are using lawless procedures in approving these spec builder applications. Here are some of the real issues:
(a) Our Southampton Village Comprehensive Plan of May 2000 (last one
dealing with the entire Village) states that we should (I) keep the open
spaces; and (II) keep houses SMALL both in old and new subdivisions.
(b) Zoning, by New York State law, is supposed to IMPLEMENT A COM- PREHENSIVE PLAN, NOT violate it.
(c) Both our Village notice requirement and our Statute of Limitations for
Article 78s (which is the action I brought against the Village ARB) deprive
the Rosko Place subdivision residents of their Constitutional rights to
Equal Protection and Due Process.

The way the SPress and you have reported my lawsuits do not take these
critical core issues into account at all.

New blog targets architecture in Southampton Village

I share Sally's objective of getting our Village neighbors to take active part
in our local government, which determines how we and our children will live
here in the future -- not only the quality of life, but the value of our properties
which are being depressed not just by the Recession but by the overhang of
unwanted, environmentally disastrous, excessively expensive to maintain
McMansions on our shy half-acres!
I tried for more than the past three years to get Vilage residents to attend
Trustee, ZBA and ARB meetings -- in vain! No one becomes aroused about
the lawlessness of this administration's boards (riddled with irreconcilable
conflicts of interest!) until the result of their decision-making appears in one's
backyard. I was no better than other Village residents. Until I was alerted, as
one of four direct neighbors out of all the owners of the 67-lot Rosko Place
development (oldest subdivision in our Village), that an 8-bedroom house was
planned by speculative builder Sandra Seroy and her husband Frank Crivella
at 37 Leo's Lane (literally in my backyard!), I was not even aware of the
two other giant spec houses that had gone up on our shy half-acres. The
Village notice requirement deprives us, residents of this development, of our
Constitutional rights to Due Process and Equal Protection. Does anyone care?
I do.
Neither my 3 years of funny letters to the editor, deploring these environ-
mentally disastrous overbuilds, nor my more recent protests based on the laws which our administration is violating have gotten any results other than
encouraging comments to me on the street by Village residents. But have they
come to the meetings? Have they tried to find out about the Village's own
laws, not to mention New York State's laws, which the ARB and ZBA and
trustees are violating? Not at all.
And so, people get the government they deserve. And this one is the worst that I remember since 1959, when I first came to Southampton! Please under-
stand that I'm not a casual visitor -- I live here, and I am a land-use litigator,
fully qualified to make these comments. And of course, I add my heartfelt good
wishes to Sally on being able to motivate our Village residents to take the time
and make the effort to attend meetings that affect all of our lives -- quality of
life, value of our properties, and whether we will continue to drive out our
middle class.

Southampton Village building inspector fell short on certification hours

Actually, we have the New York State records for the past ten years of
Jonathan Foster's tenure, and they show that he had not been certified between 2003 and 2009. Perhaps he was too busy with his daytime job --
selling real estate.
We had that official New York State record from a FOIL request, and, as
a matter of fact, I dropped off those documents and a summary of my comments to Mayor Epley and the trustees for Colleen Reynolds at The
Southampton Press on Friday morning. She's a very nice girl, and emailed me
her thanks, but she used the biased material supplied by some one represent-
ing the Village administration -- probably Rick DePetris.

Please notice that all my comments published in 27 E and my letters to the
editor in The Southampton Press correctly state my name. I always stand
four-square for and with my stated opinions.
This has not been the case with the sometimes-illiterate, but virtually always ad feminam, attacks on me. Would you please either (1) let us know
who posted the "witch-hunt" and other derogatory comments about me,
because they may give the police a clue about the persons responsible for
the malicious mischief and telephone harrassment to which I have been
subjected; or (2) refuse to print personal attacks like those against me if
their author hides behind anonimity. What cowardice!

opinion? I always do. Won't you please also not hide behind anonimity? How
can we have an intelligent debate about the many issues surrounding the
Epley Administration if you simply make an ad feminam comment and hide
your identity? Instead, we could have a cup of coffee or glass of wine at
Driver's Seat, or you name it, and discuss the important issues which are
overhanging our unsold inventory of Village real estate and putting our properties under water.

Perhaps, but in this bad economy, most people are scrambling for work.
At any rate, what is your point? Is this another anonimous (cowardly)
ad feminam attack on me, or are you making a comment about the Village
Building Inspector, who actually has two jobs: building inspector (with or
without portfolio) and real estate broker!
Perhaps we could have a fruitful dialog if you revealed who you are and
were willing to stand up for your comments. Heaven knows, I always do.
I do look forward to hearing from you, but from past experience, I won't hold
my breath. Your call or email and revelation of your name to 27 E would be
most welcome.

Court dismisses Konrad's claims of defamation

It seems futile to set you straight, because you still insist that my "long term war"
has been against McMansions. It's true that I don't like huge houses on small
lots, and today, with greater awareness of the damage to the environment from
huge footprints (and added air conditioning, heating, sewage), the taste in our
country has changed drastically, the the Thorsten Veblein competition for
conspicuous consumption is out of favor. Of course, the Southampton Village administration has not yet caught on to this trend, but a look at Corcoran's
five years of oversupply of "McMansions" on the entire East End should give
a broad hint.
As I had mentioned, in some detail, in my January comment, my fight is against
the corruption and lawlessness in our village administration, again recently
proved with the outrageous abuse of office by Trustee Paul Robinson in
getting a ZBA variance to subdivide two of his corner properties (out of his
eleven Village properties), and the vote by the Planning Board to unjustly
enrich this "trustee" by granting his subdivision -- All this in spite of the
233 signature sof residents opposed to his subdivision, because of the precedent
it sets for the Village character.
Incidentally, those 233 signatures come into perspective when you realize
that just barely over 1,700 persons vote in this village.
A last word for the moment: the first victims of corruption are our civil
liberties.

Konrad loses motion to re-argue case against Southampton Village ARB

Dr. Fox did not want to appeal Judge Mayer's decision, and of course, I did not
go ahead because of her wishes.

However, there are additional issues in that case, such as the fact that the owner
of that 17 Adams Lane property has claimed, frequently and falsely, that he is
not part of the Rosko Place subdivision. This claim is belied not only by the
official map of his portion of the Rosko Place subdivision, filed with the Suffolk
County Clerk in 1960, but a title search, which that owner had to have done,
also traces the ownership of his property right back to Leo Rosko.

An appeal would have been warranted.

Southampton Town Justice Censured By State Commission On Judicial Conduct

Most encouraging news, but that's a small start on judicial misconduct. What
about magistrate and Article III judges who deviously misstate the facts of a
case, wrongly cite law and cite inappropriate law in order to give themselves
permission to protect politically powerful defendants, and who have the temerity to threaten an officer of the court with financial ruin if said officer
persists in exercising her First Amendment rights to seek redress in court from the oppressive decisions and violations of her and other village residents civil rights by a corrupt village administration. May we expect some progress on that front in the near future? Or does big money and tea party
politics rule over the East End in perpetuity?

Starbucks Plans Hampton Road Location; Southampton Mayor Won't Support Store

Hell, all Starbucks has to do is to pay off the same Epley gang members that
Citarella paid off. Mayor Epley's protest is a prelude to his ZBA providing Starbucks with the special exception and, he, the godfather of corruption, will claim innocence and helplessness.
As for the residents' protest? Ask the Southampton Association how much good it did (before the ZBA and the NYS Supreme Court, that they had 233 signatures from residents opposing the subdivision of the Paul Robinson two corner properties? How much good do you think the 85 letters from homeowners, gathered by John Paulson in opposition to the McMansion planned for 483 Hill Street, will do? None. Mr. Paulson and his 85 protesters
will be steamrolled in the ARB sham hearings. They will also lose in the sham NYState Supreme Court in Riverhead, if they go that route, instead of
Federal court.
Isn't it time for the residents to find out what their rights are? I am a licensed
attorney with two law degrees and seven years of experience in land-use
litigation in New York and Southampton. I am offering to provide both the
legal information and the government documents and statute and case law
backing up residents' just protests, and I DO NOT CHARGE ANY FEES to
Southampton residents. I, myself, have been funding my legal battle against the Epley bunch for the past seven years. My current case v. Epley et al. is in
the Second Circuit Court of Appeals. The Epley bunch has had great success
subverting justice, bribing law clerks and judges, but I doubt that they can reach all three of the judges who will be deciding my case.
In the meantime, do take advantage of my offer. What's in it for me? The more of us who fight this corrupt Epley administration, and the trustee toadies
who enable them, the sooner we get to restore our historic village!

Local Push To Save Pyrrhus Concer Homestead Gaining Traction

Why is the Town doing it? It's the Village trustees who "settled" this fraudulent
lawsuit, which had the cooperation of mayor Mark Epley and ARB and Building
Department lawyer Elbert W. Robinson Jr. And the bogus lawsuit was brought
with the intention of nullifying the 13 December ARB decision, written per usual by Elbert W., which correctly stated that the Concer house at 51 Pond Lane should be preserved. Remember that the owners of that property, adjacent to their 37 Pond Lane property, did NOT sign their purported 84-page complaint in that bogus $10 million lawsuit, and the five-page bogus "settlement' was signed, ultra vires, meaning without authority but with the essential agreement of his clients Epley and Robinson, by Smithtown attorney David Arnsten, who signed on behalf of "the defendants," but the defendants in the $10 mil. lawsuit were the Village of SH and the members of the ARB. He was and is the attorney for mayor Epley and lawyer Elbert W. Robinson, Jr., in my lawsuit, Konrad v. Epley et al., 13-4885 Second Circuit Court of Appeals, for which I will be filing a writ of certiorari with the US Supreme Court as soon as the 2nd Circuit denies my 20 January 2015 petition for "rehearing by panel and hearing by 2nd Circuit Court of Appeals" en banc, meaning all the judges, not just the 3-judge panel. P.S. If a FOIL request will
provide you with the mandatory resolution by the Village board of trustees
naming David Arnsten Esq. as attorney representing the Village and the members of the ARB, you will be one step closer to legitimizing what is a totally
bogus $10 million lawsuit, cooked up by Elbert W.

It looks as if the Epley-Robinson group keeps going from fraud to fraud, and
making their felonious behavior more serious each year!

Southampton Village Board Considers Requiring Permits To Cut Down Trees On Residential Lots

What monumental hypocrisy!!! The stooges, starting with mayor-for-life Epley, who caused the loss of trees (and lawns) with their illegal and catastrophic Zoning Code of 2005 are now bemoaning the predictable results!
Why not just call (1) the loss of trees; (2) the loss of our Village character and
history; (3) the increase of choking traffic; (4) the eye-sore hulking Mc- Mansions the "unintended" consequence of greed, bad legislation and corruption, and go back to what the residents asked for in the Village Com-
prehensive Plan of May 2000: smaller houses, bigger lawns! It would be
cheaper than risking a merited RICO lawsuit in Federal Court. Although with
the prevalence of George W. Bush-appointed Article III judges, even such a
well-documented lawsuit would have a snowball's chance in hell.
