Mr. Biss is correct. Site Plan conditions of approval do not "run with the land" like a recorded covenant would. The conditions only apply to Mr. Biss if he is attempting to use the site plan for his current use. He is free to make a new application for different permits and a different site plan. This is an important disttnction that the village building inspector and the village attorney are glossing over. Very funny that they are inaccurate yet they insult Mr. Biss for lack of knowledge. WH Dunes is a tiny little village with a Town Beach and seven other public beach access points! Kudos to WH Dunes for protecting beach access. As far as the deep pockets issue goes - the Trustees spent 1,800,000 on their attorney for these cases and lost, WH Dunes spent less than 100,000 and won. Do you really think the administrators would take on all of the heat that comes with firing a coach if there was not more to the story? Montauk Homeowners Sue Over East Hampton Town Demands To Inspect Artist's Studio

The Courts have repeatedly ruled against municipalities requiring searches of private property. In Sokolov v. Village of Freeport, 52 NY2d 341, the NY Court of Appeals declared a village ordinance unconstitutional because it required the homeowner to submit the property to a warrantless inspection in order to renew a rental permit. In ATM One LLC v. Incorporated Village of Hempstead, 91 AD3rd 585, the Second Department of the Appelate Division held that a Village law was unconstitutional because it required a site inspection to get a rental permit. Towns and Villages like to require inspections for Updated COs and for rental permits, however, the courts have repeatedly held that they cannot legally do so. The situation here is very similar, the Town wants on-site inspections to let them continue to use the artists studios but requiring such inspections is unconstitutional." Apr 26, 17 9:33 AM
