Michael Lohan charged with harassing fiancee Kate Major at Water Mill home

Jul 22, 2010 3:53 PM

Michael Lohan has been charged with harassment after police said he flipped over a sofa chair his fiancee was sitting in, threw a shoe at her and kicked her in the mouth, according to a complaint she filed in Southampton Town Justice Court on Monday.

Mr. Lohan, the father of actress Lindsay Lohan, has yet to appear in court on the charge of harassment in the second degree, a violation, according to the court. He lives in Water Mill with his fiancee, Kate Major, but after the alleged incident at around 2 p.m. on Monday he traveled to California to attend his daughter’s sentencing for violating probation. It is unclear if he has returned to New York.

“My left collarbone is sore and my right knee is scraped,” Ms. Major said in a signed deposition, in which she said Mr. Lohan started an argument with her because she didn’t answer her cell phone when he called.

“After he kicked me he said, ‘I am going back to jail, because I’m going to kill you,’” she continued. “I am very scared of Michael Lohan and I want to pursue charges against him for harassment and get an order of protection against him.”

Southampton Town Justice Andrea Schiavoni issued an order of protection on Wednesday that allows Mr. Lohan to continue to reside at the couple’s Water Mill house but bars him from acts or threats of physical violence against Ms. Major and from purchasing firearms.

Mr. Lohan could not be reached for comment Thursday.

He kicked her in the face and the charge is harrassment? Isn't that assault?

its not assault unless she sustained an injury, ie cut, bruise, etc
By CaptainSig (716), Dutch Harbor on Jul 24, 10 7:04 AM
He kicked her in the face and the order of protection lets him live in the house. What does he have to do put her in the hospital before she can get an order of protection that keeps him away from her? Go away Lohan we don't need you here.
By favaunt (24), Sag Harbor on Jul 22, 10 7:19 PM
I don't get giving someone an order of protection and letting them live in the same house as the victim. Is that like, "just say no."
By Infoseeker (280), Hampton Bays on Jul 22, 10 10:03 PM
Silly question but why wouldn't she be his ex fiancée by now?

I don't get it either. Why would she still want to stay with him and why in the world would you grant an order of protection that keeps you in the same house. I love the "bars him from threats or acts of violence" line. That is the stupidest thing I ever heard of. Does anyone really think those words will change his anger? Of course if I were Ms. Major I'd be long gone.

I guess he's not presumed innocent. I say that she decides down the road to "drop the charges." By the , way . . . who really cares?
By HB90 (164), southampton on Jul 22, 10 11:15 PM
Good point.
By bb (922), Hampton Bays on Jul 28, 10 11:24 PM
Ummm, who cares?

Why is this even NEWS?

I know I have better things to lose sleep over.

Just stop ingratiating this idiotic behavior. It's not only not worth the newsprint, it's not even worth the energy at the keyboard.

As a matter of fact, I just wasted a minute I'll never get back to poke fun at this. At least it may have been worth it...

Oh, yes, besides being famous for his behavior, he;s also the father of a famous person once at the top of her game, but now on the skids.

Michael Lohan is a loser!! Why would Epley want to even be associated with this idiot?!
By Miss K. (103), East Quogue on Jul 23, 10 10:02 AM
One thing this is doing in the Press is pointing out that if you have the right connections in town, you are charged with a much lesser offence than most of us would get for turning over a chair, then kicking a person in the face. Then a silly restraining order, and the article oh-so-quickly becomes difficult to find on the Press site.
By SusieD (115), Southampton on Jul 23, 10 6:38 PM
here we go with the "connections" in town- what connections does this loser have? please explain.

the charges are correct- read the penal law before you start with the conspiracy crap.

i think he should be charged with 2 counts of who gives a crap
By CaptainSig (716), Dutch Harbor on Jul 24, 10 7:10 AM

I thought it was the Presses policy to not allow comments on articles about alleged criminal attacks unless the person in question is a politician because they are "public figures". I guess Mr. Lohan falls under that category? Thanks for setting your standards up there with the NY Post...
By Nature (2966), Hampton Bays on Jul 29, 10 10:22 AM
Mr. Lohan qualifies as a public figure because of his celebrity status, and that's why commenting was permitted on this story.
By BOReilly (135), 27east Web Editor on Jul 29, 10 10:25 AM
"A public figure is a legal term applied in the context of defamation actions (libel and slander) as well as invasion of privacy. A public figure (such as a politician, celebrity, or business leader) cannot base a lawsuit on incorrect harmful statements unless there is proof that the writer or publisher acted with malice (knowledge or reckless disregard for the truth). The burden of proof is higher in the case of a public figure."

n., pl., -ties.
1.A famous person.
2.Renown; ...more

Mr. Lohan is NOT a celebrity, he is the father of a "celebrity".
