Update: No Charges Filed Against Driver Who Killed Pedestrian Friday Morning

Police will not press charges against the driver that struck and killed a 44-year-old man early this morning on County Road 39.

The victim was identified as Paulino Zeledon Hernandez by police, though they did not know where Mr. Hernandez was from. According to a release sent by police, Mr. Hernandez was dead when they arrived on the scene around 6:30 a.m.

Police did not release any information about the driver of the vehicle, who was heading westbound on the highway. Detective James Mazzio said there was "no evidence of criminality," and no arrest will be made.

Update: 10 a.m.

A pedestrian attempting to cross County Road 39 from south to north was struck and killed by a car heading west, according to officials. The accident occurred at approximately 6:20 a.m. The driver of the car was unhurt; the pedestrian was the only person injured.

The pedestrian was crossing in the vicinity of the intersection of Henry Road and County Road near the western edge of Sacred Hearts Cemetery. There is no traffic light or crosswalk at that location.

Update: 9:44 a.m.

The eastbound lane of County Road 39 has been reopened, according to a traffic alert.

Update: 9:30 a.m.

An updated Southampton Town traffic alert said that County Road 39 is closed both directions between North Sea Road and Sandy Hollow Road.

County Road 39 is closed for Friday morning rush hour between Sandy Hollow Road and Tuckahoe Road while police investigate a serious accident.

Town Police and Southampton Volunteer Ambulance responded to a call at around 6:20 a.m., but officials have not released further details about the accident. It is not known how many cars were involved or if there were any injuries.

The closure has been in effect since 6:30 a.m. and police did not know when it would reopen.

Not a peep about the traffic back-up? Poor driver is my take, poor judgement on traffic speed and or distance for the pedestrian. Technically he was "Jay Walking" which is the only option for crossing CR 39 for long swaths...

How pethatic is life when it takes a Fatal accident to STOP the relentis speeding CUT THRU traffic that rips thru my private little street every morning starting at 5:30am ever morning. When I went to the end of the street to see what happened there was this poor man lying DEAD in the road without a cover over his lifeless Soul !!! When will drivers in THE HAMPTONS SLOW DOWN !!! Yes SPEED KILLS !!! RIP Sir !!!!!!

You don't know if the driver was speeding. 35 MPH is fast enough to kill a pedestrian.

Pedestrian over passes no thank you. We need more cops to strictly enforce the 35 mph. Make 39 like montauk highway in Quogue where people know don't do over 40 or you get a ticket. close intersections at hill station road, HenRy road, and little Cobb road. Problems solved!!!!

How sad this story is, and how ironic that the driver was an immigration lawyer. It's heart-rending that this man took so many risks (most likely) just to be here to work (most likely) extreme hours at (most assuredly) subsistence wages, and is taken down by someone speeding past an area that routinely has a jerk-with-a-sign telling men like him to "go home". And here the family can't find the money to get him home.

with all my respect to everyone, how fast the driver was going? speed limit there is 35 mph, has to be over 45 to kill some one ,

why not even a speed ticket to the driver??? I see, was the big Melinda Rubin (Lawyer) .

so sad, to happens to poor people or Spanish Latino or whatever, if that was a White forget about it, by now the will having cameras all over. speed cameras.

stop!!! did anyone read anything about speeding? NO. Ms Rubin was at that time of day doing the speed limit but the deceased chose to run across 4 lanes of traffic and ultimately paid with his life. Please have heart felt thoughts for the deceased as well as the unfortunate driver. To state that if the deceased was white is a MAJOR disservice to those on this web site. A person killed is just that, a person, no colot or ethnic incolved. could have been anyone you might know so please stop.
